GENERAL LIABILITY
By signing the Policy Agreement, I hereby give consent for my child/children to participate in programs offered by Alexandrea Autaubo or Beyond The Keys and hereby agree that I, for myself, my children, adopted or otherwise heirs and executors, waive and release all rights and claims for damages that I may have at any time against Alexandrea Autaubo or Beyond the Keys or their agents or representatives, for any injury or damages in connection with my association or my child’s entry, or any child or person in attendance with my child, in music or other activities sponsored by Beyond the Keys and Alexandrea Autaubo. This release is valid for the conditions set forth and acknowledged that Alexandrea Autaubo or Beyond the Keys may terminate our participation at any time.
I hereby give consent for my child/children to be recorded in audio and/or visual formats for Beyond the Keys or Alexandrea Autaubo. Any such recordings (photographs, video, sound recordings, etc) may be subsequently used without compensation to me or my child by Alexandrea Autaubo or Beyond the Keys, or third parties for publications (including web sites), advertising, and/or publicity purposes at the discretion of Alexandrea Autaubo or Beyond the Keys. I waive the right to inspect or approve the finished recordings and/or publications used.
COVID-19 LIABILITY
Assumption of the Risk and Waiver of Liability relating to Covid-19: The novel coronavirus, covid-19, has been declared a worldwide pandemic by the World Health Organization. Covid-19 is extremely contagious and is believed to be mainly spread by in-person contact. As a result, federal, provincial, and local governments and provincial and state agencies recommend social distance measures, and have, in many locations prohibited the congregations of large groups of people. Beyond the Keys and Alexandrea Autaubo has put in place actions and preventative measures to reduce the spread of covid-19; however, Beyond the Keys and Alexandrea Autaubo cannot guarantee those who enter the premises will not be infected with covid-19. Attending in-person lessons could increase risk of contracting covid-19 for all in attendance. By registering my child or myself for lessons, I acknowledge this agreement. I acknowledge the contagious nature of covid-19 and voluntary assume the risk that my child(ren) and I may be exposed or infected by covid-19 by attending in-person lessons and that such exposure or infection may result in personal injury, illness, permanent disability and death. I understand that the risk of becoming exposed to or infected by covid-19 at Beyond the Keys and Alexandrea Autaubo may result from the actions, omissions, or negligence of myself and others, including but not limited to, the Autaubo Family, volunteers, program participants and their families. I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to my child(ren) or myself (including, but not limited to, personal injury, disability and death), illness, damage, loss, claim, liability or expense of any kind, that I or my child(ren) may experience or incur in connection with my child(ren)'s attendance or participation in any activities associated with Alexandrea Autaubo. On my behalf, and on behalf of my children, I hereby release, covenant not to sue, discharge and hold harmless, Beyond the Keys, Alexandrea Autaubo or any member of Alexandrea Autaubo's family, of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of Beyond the Keys or Alexandrea Autaubo, agents or representatives, whether a covid-19 infection occurs, before, during, or after participation in any program.
